FACT CHECK · GENOCIDE, ICJ/ICC/UN, GAZA DEATH TOLL
Claim: What does 'in whole or in part' mean?
CONTEXTTHE ANSWER
ICTY Appeals, Krstic, 19 Apr 2004: 'the part must be a substantial part of that group', big enough to affect the whole group, and the aim must be to destroy it. Deaths alone don't prove that.
Art. II: any one of the five listed acts counts, but only when done 'with intent to destroy, in whole or in part' a group 'as such'.
